Due Diligence Background Check

In prior negligent hiring lawsuits, courts have found companies not liable for negligently hiring a person if they have done a thorough background check before hiring the individual. The courts have determined that a thorough background check consists of 1) Social Security Number Trace 2) search of records in counties of residence (7 years), 3) search of records in states of residence (7 years).

Other searches that you may want to run, depending on the applicants position is civil history searches for judgments, law suits, etc.. Credit Reports, and/or Driving History Checks.

We handle many different types of employment and business related investigations, including internal theft investigations, sexual harassment, work place violence investigations, and pre-employment background checks.

For your pre-employment checks, we recommend that as a minimum you complete the Basic Background Check on all of your employees. This will verify that the Social Security Number is Valid, is registered to the Applicant, and will provide a list of past addresses the applicant has lived at. We can then compare those addresses to the ones the applicant has provided. Dishonest applicants will often leave off addresses where they have been in trouble in the past.

We can then do a criminal history search of the county(s) they have lived in and the State(s) they have lived in over the past 7 years.

Then depending on the position the person is being hired for, may other possible checks are available, from driving histories to Sex Offender status.

In prior negligent hiring lawsuits, courts have ruled that checking the applicant’s SSN, and the states and counties of residence they have lived in over the past 7 years, is the minimum requirements for showing due diligence.
